We: WebPixel / Touch IT Solutions
WebPixel will provide the service to the customer for the period that is paid for in advance. If this is not possible a refund for the remaining period of service will be refunded.
WebPixel reserve the right to terminate any accounts, at any time, as deemed by WebPixel staff, where the user has made inappropriate or unreasonable use of any of the WebPixel services.
WebPixel take no responsibility for any information loaded to our customers accounts or servers. We do not have the time or inclination to police your data. If it is brought to our attention, by the proper authorities we will suspend service on accounts or servers, until any illegal data is removed.
WebPixel is not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss.
We reserve the right to refuse to serve the materials of any existing user making inappropriate or unreasonable use of WebPixel services or an applicant whose planned web presence activities are deemed to have the potential of creating negative impact on WebPixel abilities to serve its customers.
Inappropriate or unreasonable includes providing copyrighted, materials without authorization, providing obscene or offensive, materials (e.g. pornographic materials), providing materials, whose nature and/or volume compromises the ability of WebPixel servers to serve other users' web presence, materials that violate the commonly accepted etiquette of the Internet or providing materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the user, not WebPixel.
WebPixel may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available WebPixel reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby WebPixel continues hosting the website for an additional fee.
The customer will fully indemnify WebPixel against liability (of any nature), which may befall WebPixel as a result of the customers legal of illegal use of the services. WebPixel do not provide refunds in cases of abuse.
WebPixel will not be responsible for any damages your business may suffer. WebPixel makes no warranties of any kind, expressed or implied for services we provide. WebPixel disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by WebPixel.
Any accounts that cause WebPixel servers to be attacked in any way will be terminated without a refund.
Spamming or any type of UCE (Unsolicited commercial e-mail), is strictly prohibited, and your account may or will be closed immediately without a refund if you are found to be doing so.
The "Powered by WebPixel" must remain intact in the footer of all client websites
All website designs and templates belong to WebPixel and may not be used elsewhere unless the design was originally owned by the customer and imported into the WebPixel system.
WebPixel reserves the right to alter these terms of conditions at anytime and without notice.
